04/15/2009 HARDI Calls on CARB to Guarantee Confidentiality
On April 13, 2009, HARDI submitted this letter to the California Air Resources Board (CARB) to urge the agency to guarantee the confidentiality of refrigerant sales data that their proposed regulations would require HVACR distributors to submit to the state. The latest draft of proposed regulations, HVACR distributors would be required to submit to CARB the types and quantities of refrigerants sold to specific customers and their delivery addresses. To date CARB has claimed that the California Public Information Act prevents the agency from extending any guarantees of confidentiality, but HARDI argues that such data meets the definition of a “trade secret” and is therefore exempt. |
